Medical Malpractice Insurance
With the rise of private healthcare provision, medical professionals increasingly need to be aware of the need to have adequate protection in place in the form of Medical Malpractice Insurance cover. It provides medical professionals with indemnity protection in circumstances where a patient, their family or representatives make a claim that injury, mental harm or misdiagnosis to a patient has been caused.
Who needs Medical Malpractice Insurance cover?
If you are an individual medical professional undertaking non-NHS, or medico-legal work, even where it is provided on NHS premises. At JMG Insurance Brokers, we have a team of insurance professionals who can help you get the correct policy. We can also provide medical malpractice insurance cover to GP surgeries and private healthcare providers.
What protection is provided by a Medical Malpractice Insurance policy?
Medical malpractice insurance provides legal expenses and cover for damages awarded for claims for breach of your professional negligence as a medical professional. Claims can result from injury, physical or mental harm, or misdiagnosis to a patient.
Most claims result from disgruntled patients and can often be simple accusations, however even spurious accusations need to be defended to protect your reputation, which still results in legal fees to defend the accusation.
Medical malpractice cover which is provided by a traditional Insurance Company is nearly always written on a “claims made” basis, this requires the policy holder to have cover in place, not only when the negligent action is carried out, but also when the claim or accusation is reported to you. Consideration should always be made when retiring or if you chose to close your practice to arrange an extended reporting period also known as “Run Off Cover” to continue to protect yourself for any further claims or accusations after the date that you cease to practice.
It is not uncommon for a claim to appear from nowhere several years after the treatment was provided.
